SaaSFactory.ai Flow-Down Terms
These are the minimum clauses you must include in your product’s end user terms and privacy policy before taking end users (terms, clauses 15 and 43.3). They protect you, your end users and SaaS Factory. Adapt the wording to your product’s voice; keep the substance. They are a starting point, not legal advice: check them against your market before publishing.
1. Payments agent. “Payments are collected on our behalf by our platform provider, SaaSFactory.ai, acting as our agent. Payment to them is payment to us.” (Required by terms, clause 12.1.)
2. Stored card consent. “By saving a payment card, you authorise us to charge it for recurring or later payments under your plan, until you cancel.” Consent must be captured at the point the card is stored; it is a card network requirement (clause 15.1).
3. Refund policy. Publish one, and link it wherever payment is taken. A template is provided under Terms & Legals (clause 15.1).
4. AI disclosure. “This product is built and operated with AI. AI features, including AI workers and AI support, may act on your requests and answer your questions. AI output can contain errors; important information should be verified.” Cover AI workers with edit access explicitly if you enable end user elevation (clauses 15.2 and 22.3).
5. Activity monitoring. If you enable identity level user monitoring: “We monitor activity within the product, linked to your account, to operate, secure and improve the service.” Your privacy policy must disclose it (clause 49.3).
6. Third party services. “The product runs on third party infrastructure and connects to third party services; their availability is outside our control.” Mirrors clauses 23 and 51.2, so their expectations match your obligations.
7. Build requests. If end users can submit feedback or build requests: “Feature requests may be built, changed or declined at our discretion. A request is not a commitment.” (Clause 26.3.)
8. MCP and AI connections. If your product exposes an MCP or AI connection surface: “What your connected AI client does through its connection is your responsibility.” (Clause 50.3.)
9. Your own liability terms. Set a liability cap and exclusions with your end users. Our platform terms cap our liability to you; without your own cap downstream, you carry uncapped exposure we do not cover (clause 57.3: your end users’ claims are excluded from our liability).
10. Keep them current. When you enable a new capability (AI workers for end users, monitoring reveal, MCP), update your end user terms the same day. The gate on payments and email channels checks these pages exist; keeping them true is on you (clause 43.3).
