# Terms of Service — Making Tax Digital

## 1. Introduction
These Terms of Service ("Terms") govern your use of Making Tax Digital ("the Service"), operated by **AgentOS Proptech Group Ltd** (Company No. 05409547), registered at 13 Lambourne Crescent, Cardiff, CF14 5GF, United Kingdom ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
## 2. Service Description
HMRC-compliant Making Tax Digital platform for landlords and property businesses. Handles quarterly VAT submissions, income tax reporting, and digital record keeping.
## 3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.
## 4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit malware, spam, or other harmful content
- Exceed reasonable usage limits or abuse API access
## 5. Payment Terms
Paid features are billed in advance on a subscription basis. All fees are exclusive of VAT unless stated otherwise. We reserve the right to modify pricing with 30 days' written notice. Refunds are provided in accordance with the Consumer Rights Act 2015.
## 6. Data Protection
We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. Our Privacy Policy, available at the /privacy page, details how we collect, use, and protect your data. We act as data controller for account data and data processor for any data you input into the Service.

## 7. Intellectual Property
All intellectual property rights in the Service (including software, design, and documentation) remain with AgentOS Proptech Group Ltd. You retain ownership of all data you input into the Service. We claim no intellectual property rights over your content.
You grant us a limited licence to process your data solely for the purpose of providing the Service.
## 8. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
## 9. Termination
Either party may terminate these Terms with 30 days' written notice. We may suspend or terminate your access immediately if you breach these Terms.
Upon termination, you may request export of your data within 30 days. After this period, we will delete your data in accordance with our data retention policy.
## 10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
## 11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
